How Surveillance Can Hurt Your Workers’ Comp Claim

It sounds like something out of a spy movie, but it’s very real: insurance companies often hire private investigators to follow injured workers. Their goal? To catch you doing something that contradicts your injury claim—even if it’s completely out of context.

If you’re receiving workers’ compensation benefits in South Carolina, you should know: you may be under surveillance.

Why do insurance companies do this?

Workers’ comp insurers are in the business of minimizing payouts. If they suspect you’re exaggerating your injury—or even if they just want to find a reason to reduce your benefits—they may monitor you to try to catch you “slipping up.”

This can include:

  • Following you and recording video

  • Watching your social media accounts

  • Asking neighbors or coworkers about your activity

Even innocent behavior—like lifting groceries, playing with your kids, or walking your dog—can be taken out of context and used to suggest you’re more capable than your doctor says.

How to protect yourself:

  1. Stick to your doctor’s restrictions—always. If your physician says “no lifting over 10 lbs,” then don’t lift over 10 lbs. Even once. Even for a few seconds.

  2. Be cautious on social media. A photo of you smiling at a wedding or out with friends doesn’t show your pain afterward—but the insurance company might use it to claim you’re fine.

  3. Assume you’re being watched in public. That doesn’t mean you have to live in fear—just be aware that investigators can film you anytime you’re outside your home.

  4. Document your limitations. Keep a journal of your symptoms, your treatments, and the days you’re struggling. It helps show the full picture if something is questioned later.

Surveillance isn’t fair—but it’s legal.

You don’t have to break the law to have your benefits denied. All it takes is one carefully edited video or misleading report. That’s why having an experienced workers’ comp attorney in your corner is so important.
