What Happens at a Workers’ Comp Hearing in South Carolina?

f your workers’ compensation claim has been denied, delayed, or disputed, the next step may be a formal hearing before the South Carolina Workers’ Compensation Commission. For many injured workers, this sounds intimidating—but it’s actually a chance to present your side of the story and fight for the benefits you’re entitled to.

Here’s what you can expect.

1. The hearing isn’t in a courtroom, but it is official.

Workers’ comp hearings are typically held in an office setting, not a courtroom, but they’re still legal proceedings. A single commissioner (kind of like a judge) will preside over your case, hear evidence, and make a ruling. You, your lawyer (if you have one), your employer’s lawyer, and possibly a representative from the insurance company will all be present.

2. You’ll have the chance to testify.

You may be asked to answer questions about:

  • How your injury happened

  • What symptoms you’ve experienced

  • How the injury has impacted your ability to work and live

  • What treatment you’ve received

This is your chance to tell your story clearly and truthfully. You may also be cross-examined by the employer’s attorney.

3. Medical evidence matters. A lot.

Your medical records, doctor’s reports, and any independent medical evaluations will be reviewed carefully. If there’s disagreement about your diagnosis or ability to work, expert testimony may be introduced.

4. The commissioner will issue a written decision.

After the hearing, the commissioner will take time to review the evidence and issue a written ruling—usually within a few weeks. This decision will outline whether your claim is approved, what benefits (if any) you’re awarded, and any restrictions or conditions.

5. You can appeal the decision.

If the ruling doesn’t go your way, you can appeal to a panel of commissioners, and eventually even to the South Carolina Court of Appeals if needed. But each appeal has tight deadlines—so don’t wait.
