One of the most frustrating—and frightening—parts of a workers’ compensation claim is when your employer or insurance company starts pressuring you to return to work before you’re ready. Maybe your QRC is calling constantly, your doctor is getting nudged to clear you, or you’re being offered a job that doesn’t match your physical limitations.
If this is happening to you, you’re not alone—and you’re not powerless.
You have the right to heal safely.
South Carolina workers’ compensation law protects injured workers from being forced back into roles they can’t physically handle. Your return to work should be based on:
Your actual medical condition
A clear release from your treating physician
Realistic job duties that match your restrictions
You don’t have to go back just because someone says “light duty” is available. If the job doesn’t match what your doctor says you can safely do, you can—and should—push back.
Here’s what to do if you’re being pressured:
Get clarity from your doctor. Ask for specific restrictions in writing, such as “no lifting over 10 lbs” or “cannot stand for more than 30 minutes at a time.”
Request a written job description from your employer or QRC. Compare it directly to your restrictions.
Don’t assume they’re telling the truth. Some employers say “light duty” but expect you to perform regular tasks once you’re back.
Keep a paper trail. Save emails, voicemails, and texts that show the pressure you’re under.
Talk to a workers’ comp attorney. You may be asked to attend a hearing or defend your refusal to return. Having legal help makes a big difference.
Rushing back can make everything worse.
Going back too soon can re-injure you or make your condition permanent. It can also complicate your workers’ comp claim, especially if the insurance company argues you were cleared to work and you refused. You only get one body—don’t let them gamble with it.
