If you’ve been injured on the job, you probably have more questions than answers. Workers’ compensation is supposed to be a safety net—but the process can feel confusing, frustrating, and even stacked against you. At Martin & Martin, we help injured workers across South Carolina understand their rights and get the benefits they deserve.
Here are answers to some of the most common questions we hear:
1. What injuries are covered by workers’ comp?
Workers’ compensation covers any injury or illness that happens as a result of your job—whether it’s a sudden accident like a fall or a condition that develops over time, like carpal tunnel or hearing loss. Mental health conditions may also be covered in some cases, especially if they result from a traumatic event on the job.
2. Do I have to report my injury right away?
Yes. You must report your injury to your employer within 90 days. But don’t wait—the sooner you report it, the better. Waiting can create doubt and give the insurance company an excuse to deny your claim.
3. Can I see my own doctor?
In most cases, your employer or their insurance company will choose your doctor. If you go to your own physician without permission, the visit might not be covered. That said, you have rights if you’re not receiving appropriate care. (We have a full blog post on this topic.)
4. What if my employer says I wasn’t really hurt?
Unfortunately, this happens more often than you’d think. If your employer denies that the injury happened or claims it happened outside of work, you’ll need to file a formal claim with the South Carolina Workers’ Compensation Commission. Documentation, medical records, and witness statements can all help support your case.
5. How long will I receive benefits?
You’ll receive temporary disability benefits until your doctor says you’ve reached Maximum Medical Improvement (MMI). After that, your benefits may continue if you’re still dealing with permanent restrictions. The exact amount and length of benefits depends on the type and severity of your injury.
